TERMS & CONDITIONS (EN)
Important notice (translation & precedence): This English version is provided for convenience only. In case of any discrepancy between the English and Polish versions, the Polish version of the Terms & Conditions shall prevail.
Governing law & consumer rights: These Terms are governed by Polish law. Any disputes shall be resolved by the competent courts in Poland. Nothing in these Terms limits any mandatory consumer rights you may have under the laws of your country of residence (in particular within the EU).
I. GENERAL PROVISIONS
- These Terms & Conditions set out the rules for sales in the online store Pomidorlandia.pl operated by: Gospodarstwo Rolne Sławomir Białoboki, ul. Gady 1, 11-001 Dywity, Poland, NIP: 739-322-87-60, REGON: 519483979, phone: +48 502 957 490, e-mail: sklep@pomidorlandia.pl, available at: https://www.pomidorlandia.pl (the “Store”).
- The Store enables placing orders electronically.
- Orders can be placed 24 hours a day, 7 days a week.
- By placing an order, the Buyer confirms that they have read and accept these Terms & Conditions.
- Sales are conducted directly by the Seller (no intermediaries).
- The Terms are made available on the Store’s website in a manner enabling Buyers to obtain, reproduce and store them.
- Product prices in the Store are indicated in Polish zloty (PLN) and are gross prices.
- The price list does not constitute an offer within the meaning of law; displayed prices constitute an invitation to make an offer (Art. 71 of the Polish Civil Code). The Seller reserves the right to change prices; the Buyer is bound by the prices applicable at the time of placing the order.
II. DEFINITIONS
Terms used in these Terms & Conditions mean:
- Seller – Gospodarstwo Rolne Sławomir Białoboki, Gady 1, 11-001 Dywity, Poland, phone: +48 502 957 490, e-mail: sklep@pomidorlandia.pl.
- Store – an IT system enabling Buyers to enter into Sales Agreements, available at: www.pomidorlandia.pl.
- Customer Account – an account within the Store containing Customer data, order history and information necessary to process orders.
- Agreement – a distance sales agreement concluded between the Seller and the Buyer under these Terms.
- Terms – these Terms & Conditions.
- Materials – information on the Store website, including names, descriptions, photos and product illustrations.
- Customer/Buyer – an internet user using the Store who purchases or intends to purchase products offered by the Seller via the Store.
III. GENERAL CONDITIONS OF USING THE STORE
- A Buyer who is a natural person may use the Store provided they have full legal capacity under applicable law.
- The Buyer is obliged to provide true, current and complete data when placing an order and to comply with these Terms. The data provided must not violate applicable law or third-party rights.
- Use of the Seller’s name, the Store’s logo, Materials or any elements of the Store (including layout) without the Seller’s consent is prohibited.
- The Buyer must not disclose their login and password to third parties.
- Sales are carried out directly by the Seller (no intermediaries).
IV. REGISTRATION IN THE STORE

Buyers may:
- use the Store and place orders without registering, or
- register a Customer Account.

An Agreement may be concluded without registration if the Buyer:
- correctly completes the order form and provides the required data,
- accepts these Terms.

Registration is available to adult Buyers and requires:
- providing correct contact/address details,
- accepting these Terms.
- For legal entities or organizational units without legal personality, registration and actions in the Store may be performed only by a duly authorized person.
- The Seller may request verification of provided data in justified cases.
- If the Buyer’s data changes, it should be updated before placing another order.
- Upon registration, a Customer Account is created to store information about the Buyer and their orders.
V. PLACING ORDERS – CONCLUSION OF THE AGREEMENT
- Before placing an order, the Buyer adds selected products to a virtual cart. The cart allows calculating the total value and delivery costs.
- After selecting products, the Buyer proceeds to the order form.
- Placing an order constitutes an offer within the meaning of the Polish Civil Code. The Seller verifies the order; if the order is incorrect, the Seller will inform the Buyer.
- Placing an order creates an obligation to pay.
- Where required for plant-health compliance, the Buyer may be asked to confirm whether they are a “professional operator” within the meaning of applicable EU plant-health regulations.
- The Agreement is concluded when the Seller sends the Buyer an order confirmation (acceptance of the offer) to the e-mail address provided.
VI. PRICES & PAYMENTS
- The Buyer is obliged to pay the price (including delivery costs) no later than within 7 days of placing the order, unless the Store specifies otherwise.
- Payments are made using methods provided in the Store.
- Available payment methods may include: Przelewy24, PayPal, cash on delivery (where available), or bank transfer.
- The Seller does not issue VAT invoices. A receipt/accounting document may be issued according to the Seller’s applicable settlement method.
- Delivery costs are displayed separately in the Store (“Delivery time and costs”) and during checkout.
VII. DELIVERY
- Delivery is carried out by postal operators and/or courier companies. Available delivery options are shown during checkout.
- Delivery is paid unless the Agreement states otherwise. Delivery costs are shown in the Store and during checkout.
- Typical delivery time is up to 7 business days, unless a different time is stated in the product description or during checkout. For bank transfers, the delivery time is counted from the date the Seller’s account is credited.
- International deliveries: International shipping may be available in selected cases. International shipments may be subject to customs duties, import VAT, handling fees and local regulations. These costs are the Buyer’s responsibility.
VIII. INTERNATIONAL SHIPPING & PLANT-HEALTH (PHYTOSANITARY) RESTRICTIONS
- Due to plant-health (phytosanitary) regulations, shipping seeds to certain countries may be restricted or prohibited. The Buyer is responsible for ensuring that importing the ordered products is lawful in the destination country.
- The Seller does not guarantee that international shipments will be accepted by customs or other authorities in the destination country.
- The Seller reserves the right to cancel and refund an order if the Seller reasonably believes the shipment may be restricted by applicable laws or carrier rules.
- If a shipment is detained, refused, returned or destroyed by customs or other authorities due to import restrictions, the case will be handled individually. Any refund (if applicable) may be reduced by the actual shipping and return costs and any non-recoverable fees charged by carriers or authorities.
IX. COMPLAINTS
- The Seller’s liability towards Consumers for lack of conformity of goods with the Agreement is determined by mandatory provisions of applicable law (including EU consumer protection rules where applicable).

- Recommendation: to facilitate claims for transport damage, we recommend checking the parcel upon delivery and preparing a damage report with the carrier if needed. Lack of such report does not exclude the Consumer’s statutory rights where applicable.
- In case of damage or missing items, please contact us as soon as possible (photos are helpful) so we can resolve the matter efficiently.
- The Seller will respond to a Consumer complaint without undue delay, no later than within 14 calendar days from receipt of the complaint.
X. COSTS OF RETURN SHIPMENTS (UNCLAIMED / RETURNED TO SENDER)
- If a parcel is returned to the Seller due to reasons attributable to the Buyer (e.g., incorrect address, failure to collect within the carrier’s time limit), the Buyer may be charged the actual cost of the return shipment.
- If the Buyer requests re-shipment, the Buyer covers the cost of re-shipping, unless the return was caused by the Seller’s fault.
XI. WITHDRAWAL FROM THE AGREEMENT (CONSUMERS)
- A Consumer who concluded a distance contract may withdraw from it within 14 calendar days without giving any reason, subject to statutory exceptions. To meet the deadline it is sufficient to send the withdrawal statement before it expires.

Withdrawal may be submitted:
- in writing to: Gady 1, 11-001 Dywity, Poland, or
- by e-mail to: sklep@pomidorlandia.pl.
- The Seller will reimburse payments without undue delay and no later than 14 days from receiving the withdrawal notice, in accordance with applicable law. The Seller may withhold reimbursement until goods are received back or the Consumer provides evidence of dispatch (whichever occurs earlier), where permitted by law.
- The Consumer must return the goods no later than 14 days after withdrawal, properly secured for shipment.
- The Consumer bears the direct cost of returning the goods, unless the Seller agrees otherwise.
- The right of withdrawal does not apply in cases specified by law (e.g., for goods that deteriorate quickly, custom-made goods, sealed hygiene goods after opening, etc.).
XII. PROVISIONS FOR BUSINESS CUSTOMERS
- This section applies to Customers who are not Consumers, subject to any mandatory rules granting certain consumer-like rights to sole traders in specific circumstances.
- Upon handing the goods over to the carrier, the risk of accidental loss or damage passes to the Business Customer, unless mandatory law provides otherwise.
- To the extent permitted by law, the Seller’s liability towards Business Customers may be limited.
XIII. FINAL PROVISIONS
- Agreements concluded via the Store are concluded in Polish and/or English for convenience; the Polish version prevails in case of discrepancy.
- Matters not regulated herein are governed by applicable Polish law and mandatory EU consumer protection rules where applicable.

XV. PERSONAL DATA
- The controller of personal data collected via the Store is Sławomir Białoboki (Gospodarstwo Rolne Białoboki), Gady 1, 11-001 Dywity, Poland, e-mail: sklep@pomidorlandia.pl (the “Controller”).
- Personal data is processed in accordance with the GDPR (Regulation (EU) 2016/679).
- Providing data is voluntary, but necessary to conclude and perform the Agreement.

XVI. COPYRIGHT
No part of the Materials published on Pomidorlandia.pl may be reproduced or distributed in any form without the Seller’s consent.
